1) GENERAL TERMS OF USE (ToU)

1.1. Definitions

Application: the “DietMate” mobile and web application.
User: any individual using the Application.
Account: a personal space allowing access to the Service.
UGC (User-Generated Content): texts, photos (e.g. meals), and comments published or submitted by the User.
Health Data: data relating to the User’s health (e.g. weight, calorie intake) within the meaning of the GDPR.
Third-Party Health Services: Apple Health (HealthKit) and Google Fit.

1.8 Health: Synchronizations & Restrictions (HealthKit / Google Fit)

1.2 Purpose and Description

DietMate helps users track their diet and nutritional well-being: meal estimation (written or voice input), habit tracking, optional synchronization with Third-Party Health Services, and AI-based analysis of nutritional values.
The information provided is general and indicative in nature and is intended for wellness purposes only.

1.3 Medical Disclaimer

DietMate is not a medical device and does not provide medical advice, diagnosis, or prescriptions. It does not replace a healthcare professional. In case of emergency, dial 112 (or your local emergency number).

1.4 Acceptance of the Terms of Use

Access to the Application constitutes unconditional acceptance of the Terms of Use by clicking “I accept”. If you do not agree, access to the Application is not possible.

1.5 Access — Account — Minimum Age

Account creation is performed using an email address and password (stored in hashed form). The User must provide accurate and up-to-date information.
Minimum age: 15 years. Users under the age of 15 may not use the Service.
The User must keep their login credentials confidential and remains responsible for all activities carried out under their Account.

1.6 Configuration & Availability

Android 8+ or iOS 13+, with an Internet connection required. DietMate aims for continuous availability (best-efforts obligation), subject to possible interruptions (maintenance, updates, force majeure).

1.7 Rules of Use and Prohibited Conduct

The following are prohibited: illegal or fraudulent activities; infringement of third-party rights; unlawful content (defamation, infringement, hate speech, invasion of privacy); scraping, decompilation or reverse engineering (except where legally permitted), intrusion, spam, security circumvention, and use of outputs to train external AI systems without prior written authorization.
DietMate may moderate content and suspend or terminate an Account in the event of a breach.

1.8 Health: Synchronizations & Restrictions (HealthKit / Google Fit)

Synchronization with Apple Health / Google Fit is optional and controlled by the User through system permissions (granular and revocable).
Data originating from Health/Fit are neither sold nor used for targeted advertising or marketing profiling.
Any sharing with third parties other than our technical processors requires your explicit consent and a legitimate health or wellness use case.
Access can be revoked at any time in the operating system settings.

1.9 AI Analysis

DietMate uses AI providers to estimate nutritional composition based on user inputs (meal text, voice, and photos). AI outputs are indicative and may contain inaccuracies; the User remains responsible for their dietary choices.

1.10 Intellectual Property — License of Use

The Application and its components (texts, code, trademarks, logos) are protected by intellectual property laws.
DietMate grants the User a personal, non-exclusive, non-transferable license for strictly personal use, worldwide, for the duration of use.
The following are prohibited: reproduction, adaptation, distribution, decompilation (except where legally permitted), rental, or resale.

1.11 UGC — Service Use vs. Marketing Use

By publishing UGC, the User grants DietMate a non-exclusive, worldwide, royalty-free license to host, reproduce, and display such UGC solely for the purposes of operating the Service.
Any external promotional use (website, social media) is subject to a separate opt-in. The User represents that they hold the necessary rights and agrees not to publish unlawful content.

1.12 Liability

To the extent permitted by law:DietMate is not liable for indirect damages (loss of opportunity, data, or profits).DietMate’s total liability is capped at the amount actually paid by the User during the previous 12 months.
Exceptions: this limitation does not apply in cases of bodily injury, gross negligence, or willful misconduct.

1.13 Suspension — Termination

DietMate may suspend or terminate access in the event of a material breach of the Terms of Use/Terms of Sale, identity theft, fraud, security violations, or a legal order.

1.14 Amendments to the Terms of Use

DietMate may amend the Terms of Use. Users will be informed in advance (in-app and/or by email). Continued use of the Service constitutes acceptance. If the User does not agree, they may terminate before the changes take effect.

1.15 Governing Law — Mediation — Jurisdiction

Governing law: French law.
After a prior written request to customer support that remains unresolved, the consumer may refer the matter to the mediator within one (1) year:

In the absence of an agreement, disputes shall be brought before the competent courts in accordance with common law.

2) GENERAL TERMS OF SALE (ToS)

2.1 Scope of Application

Sale of DietMate subscriptions to consumers via the Apple App Store and Google Play.

2.2 Prices — Taxes — Currency

Prices are shown inclusive of all taxes (VAT included) in euros (€) as displayed on the platforms (may vary depending on country and applicable taxes).
Plans

Monthly: €9.90
Quarterly: €24.90
Annual: €59.90

Free trial: 7 days (if offered in your country/store).

2.3 Orders and Payment

Purchases and payments are handled by Apple / Google. The contract is concluded upon validation by the relevant platform. Receipts and invoices are issued by the platform.

2.4 Subscription — Term — Renewal — Cancellation

Monthly, quarterly, or annual subscriptions are automatically renewed for identical periods.
You may cancel at any time via your App Store / Google Play account settings before the end of the current billing period; uninstalling the Application does not constitute cancellation.
Access remains active until the end of the paid period. No prorated refund is due for any period already started.

2.5 Right of Withdrawal — Digital Content

For digital content not supplied on a tangible medium, the right of withdrawal does not apply if performance has begun with the consumer’s express consent and acknowledgment of waiver of this right (French Consumer Code, Article L221-28).
For in-app purchases, withdrawal and refunds are handled by Apple / Google in accordance with their respective policies (e.g., Apple: reportaproblem.apple.com; Google Play: “Request a refund” help section).

2.6 Customer Service & Complaints

If the response is unsatisfactory, you may refer the matter to the CM2C mediator (see Section 1.15).

2.7 Amendments to the Terms of Sale

Users will be informed in advance (in-app and/or by email). If the User does not agree, they may cancel before the changes take effect.

3) FINAL PROVISIONS (Common to ToU / ToS)

Severability: the invalidity of any clause shall not affect the validity of the remaining provisions.
Evidence: DietMate’s information system logs shall constitute proof.
Force majeure: obligations are suspended for the duration of the force majeure event.
Changelog: a summary of material changes is presented in-app and/or by email with each major update to the Terms of Use / Terms of Sale.
Effective date: September 10, 2025.
